Terms and Conditions

These terms and conditions shall govern the relationship between Wright Express Ja. a company duly incorporated under the laws of Jamaica with Head Office situated at Shop 33, Kings Plaza, Constant Spring Road, Kingston 10, Jamaica W.I. and the Customer (which shall include the Addressee and/ or Recipient of the package); collectively referred to as the Parties. This agreement provides the basis on which Wrights Express is prepared to provide freight shipping services. Legal and binding obligations shall be formed between the Parties when packages are tendered to and accepted by Wright Express for delivery. By having your Shipment delivered to Wright Express at its International Warehouse situated at 2003 W McNab Road, Ste 13 C/O, Pompano Beach, Florida, 33069 United States of America or 2713 NW 30th Avenue, Building 17, Lauderdale Lakes, Florida 33311 or 658 Upper Ottawa St, Hamilton, Ontario L8T3T5 and receipt thereof with your delivery instructions, you agree to these Terms and Conditions here.

Privacy Policy

This Privacy Policy describes Our policies and procedures on the collection, use, and disclosure of Your information when You use our Service. We use Your Personal data to provide and improve our Service. By using our Service, You agree to the collection and use of information in accordance with this Privacy Policy.

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in the plural. 

Definitions

For the purposes of this Privacy Policy: Account means a unique account created for You to access our Service.

● Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to Wright Express Ja., Shop 33 Kings Plaza, Constant Spring Road, Kingston 10.

● Personal Data is any information that relates to an identified or identifiable individual.

● Service refers to all processes, physical and virtual, We employ to facilitate the receipt, processing, shipping and final delivery of packages. 

● Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.

● Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

● Website refers to Wright Express, accessible from https://www.wrightexpressja.com

● You mean the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable

Personal Data

While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally, identifiable information may include, but is not limited to:

● First name and last name
● Telephone number
● Address
● Government-issued TRN

Usage Data

Usage Data is collected automatically when using our Service.
Usage Data may include information such as Your Device’s Internet Protocol address, browser details, the pages of our Website that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data. When you access the Website by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data. We may also collect information that your browser sends whenever you visit our Service or when you access the

● To contact You: via email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application’s push notifications regarding updates or informative communications related to the
functionalities, products or contracted services, including security updates, when necessary or reasonable for their implementation.


● To provide You with news, special offers and general information about changes to our Service unless You have opted not to receive such information.
● To manage Your requests: To attend and manage Your requests to Us.
● For other purposes: We may use Your information for other purposes, such as data analysis, identifying usage trends, to evaluate and improve our Service, products, services, marketing and your experience. 

Retention of Your Personal Data
The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy
Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for
example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal
agreements and policies.


Disclosure of Your Personal Data
Under certain circumstances, the Company may be required to disclose Your Personal Data if required to do so by law
or in response to valid requests by public authorities (e.g. a court or a government agency).
The Company may disclose Your Personal Data in the good faith belief that such action is necessary to:

● Comply with a legal obligation
● Protect and defend the rights or property of the Company
● Prevent or investigate possible wrongdoing in connection with the Service
● Protect the personal safety of Users of the Service or the public
● Protect against legal liability

We may update Our Privacy Policy from time to time. We will notify You of any changes by posting the new Privacy
Policy on this page. You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are
effective when they are posted on this page

Services

● Wright Express shall carry a package from the Collection Point, the Norman Manley International
Airport, Kingston Jamaica or the Kingston Wharves to the Delivery Point which is Wright Express’s
Head Office.
● The Customer making a request for the carriage of the package from the Collection Point to the
Delivery Point using one of Wright Express Motor Vehicles and shall pay the requisite Fees for the
Services required.

Items not acceptable for Carriage

The Customer shall not submit for carriage and Wright Express shall not accept for carriage the following items in accordance with industry best practices and Customs Rules and Regulations:

● Money or cash or items readily convertible to money (including but not limited to coins or negotiable  instruments equivalent to cash such as cheques, endorsed stocks, bills of exchange, bonds or other  securities)

● Gold or silver, precious stones, valuables, antiques, pictures (apart from commercial artwork), stamps or unique items and jewelry;

● Perishable goods, food, liquids, livestock, plants, drugs, medicines or alcoholic beverages (unless  previously agreed to in writing) and we shall have no liability (whether caused by negligence or otherwise)     for loss, damage, non-delivery, mis-delivery or late delivery of the same;

● Goods which might endanger human or animal life, which might damage other goods being transported by the Company, or the carriage, import or export of which is prohibited by applicable law;

● Noxious, dangerous, hazardous, explosive or inflammable items, firearms including parts of firearms, ammunition or detonators, or any goods likely to cause damage;

● Shipments constituting items which in our discretion we cannot transport legally or safely.

● If the Customer submits any such goods to Wright Express for carriage otherwise than by special arrangement previously made in writing, Wright Express shall be under no liability whatsoever in connection with the goods however arising.

● All packages shall be delivered in accordance with the terms and conditions of Wright Express. Wright Express reserve the right to reject packages based on the above limitations or for reasons of safety or security 

Customer’s obligations:

When making a request for the carriage of a package, the Customer shall inform Wright Express of:
● The quantity of packages;

● The size, weight and dimensions of each package;

● The nature of the contents of each package;

● The destination(s) the package(s) are to be delivered, where necessary;

● Any special requirements regarding the handling or transportation of the package(s)

● The Customer shall certify that shipment details are complete and accurate and shall agree, whether acting on his/her own behalf or as an agent for and on behalf of any other person having interest in this delivery, to all the terms and conditions hereof and to any applicable tariff, laws and/ or regulations.

● The Customer shall ensure that packages transported to Wright Express for delivery are securely packed and properly marked with the address.

● The Customer shall make correct declaration of the size of the package in terms weight, length and width.

● The Customer shall be liable to undertake any additional charges to handle the importation of packages that are larger than was originally stated.

● The Customer shall pay all shipment charges and destination duties and taxes for this shipment if the receiver or third party does not pay.

● The Customer shall pay all shipment charges including but not limited to incorrect declaration of cargo, improper or insufficient packing securing marking or addressing of the Shipment, or for the acts or omissions of the recipient or anyone else with an interest in the Shipment.

Inspection

For reasons of security, Wright Express may inspect or scan any package at random prior to shipping and delivery.

Wright Express undertakes to deliver packages to Wright Express’s Head Office or to the Delivery Point depending on the request of the Customer. Subject to any special instructions agreed between Wright Express and the Customer, Wright Express shall deliver the package at the Delivery Point to the person named as recipient or to some other responsible person at that address who is representing the interest of the Customer. Wright Express shall not be liable if any person at the delivery address misrepresents his or her position to receive a package on the Customer’s behalf.

Collection/Delivery of packages

● Wright Express shall ask the person receiving the package to sign a receipt, which may be in electronic form and which shall constitute proof of delivery. The Customer may be provided with a copy of the receipt within Forty-Eight (48) hours from the date of delivery. Such a receipt shall be conclusive evidence as to the fact and time of delivery of the package and, apart from any
observation to the contrary noted on the receipt, evidence that the package was delivered in good condition.

● Wright Express shall call or send email advisory to Customer regarding any unclaimed packages. If Wright Express is unable to reach the Customer by phone or otherwise after numerous attempts the package shall be kept at Wright Express’s office and sold after a period of sixty (60) days.

● Wright Express shall make every effort to deliver the Customer’s Shipment according to our regular delivery schedules. Wright Express shall not be responsible for any delays in collecting a shipment, transporting a shipment (including delays caused by any diversion) and delivering a shipment
occasioned by the following circumstances:-

(a) Act of God including but not limited to storm, tempest or flood;
(b) Act of war hostilities riot or civil commotion or the threat or fear of such conditions prevailing;
(c) Criminal malicious or negligent actions or acts or omissions of third parties.
(d) Industrial action or unforeseeable traffic conditions;
(e) Suspension or cancellation of transport services by reason of or of the threat or fear of inclement weather;
(f) Fire, lightning or explosion;
(g) Seizure under legal process;
(h) Your act, default or omission of whatever nature, or act, default or omission of your employees
or agents or any person having any interest in the goods;
(i) Insufficient or improper packing labeling or addressing; or
(j) The unavailability at the delivery address of the consignee or other authorized recipient.

Fees

Fees are subject to the value of goods.

Method of Payment

Payment shall be made by the Customer using electronic means, online bank transfers, manager’s cheque
or cash only.

Procedure for Claims in case of loss or damage to packages

The Customer shall check all shipments upon receipt and before leaving the office of Wright Express to report any damage, missing or otherwise useless items. Failure to do so shall result in waiver of the right of the Customer to submit a claim and/ or Wright Express accepting responsibility for the said claim.

● The Customer shall substantiate and submit any claim on a completed claim form providing to Wright Express all relevant information about the package, including proof of receipt by Wright Express, proof of value, estimates for cost of repair, invoices, within three (3) business days of delivery.

● Wright Express may make such investigations as it considers necessary to satisfy itself of the validity of any claim and the contents, original shipping cartons and packing must be available to us for inspection.

● Wright Express’s maximum liability for loss of or damage in connection with the Customer’s delivery shall in no circumstances exceed the value of the Shipment or where the Customer is not the owner of the Shipment then your liability to the Owner (whichever is the less).

Laws

This Agreement shall be governed by the Laws of Jamaica.

Headings/ Titles

Headings are inserted for the convenience of the parties only and not to be considered when interpreting this Agreement.

Mandatory Law

Insofar as any provision contained or referred to in this Agreement may be contrary to any applicable law, government regulations order or requirements, such provision shall remain in effect as part of our Agreement to the extent that it is not overridden. The invalidity or of any provision shall not affect any other part of this Agreement.
